The Decision on the Amendment of the On Pricing Of Medicinal Products For Human Use (“Amending Decision”) has been published in the Official Gazette dated 9 November 2022 and entered into force.
The new provisions brought by the Amending Decision are as follows:
Discount practices, special practices regarding product classification, and special taxation practices that cause temporary price changes in the country or countries where the product is offered for sale will not be taken into account in the real source price calculation.
Products that are not sold at the retail level in the country or countries where the product is offered for sale and is offered for use only through hospitals will not be taken into account in the real source price calculation of products that are sold at the retail level in Turkey.
Firms that make an application must submit the documents proving the above situations to the Turkish Medicines and Medical Devices Agency together with the application.
