The video recording of the presentation entitled “Gun Jumping Violations in Mergers and Acquisitions: An Examination of Recent Case Law in the European Union and Turkey and Best Practice Examples”, delivered by our Founding Partner, Nuri Melih İnce, on 7 April 2026 as part of the Istanbul Bilgi University Competition Law in Practice Seminars 2026, has been published on YouTube.
It is well known that competition authorities have recently intensified their scrutiny of notifiable mergers and acquisitions implemented without prior approval, commonly referred to as “gun jumping,” and have imposed fines on undertakings in this context. The presentation examined, in particular, the limits of concepts such as the “exercise of de facto control” and the “exchange of competitively sensitive information” during the pre-closing period, while also discussing high-risk conduct and contractual provisions.
