Seminar: "Recent Decisions on Market Access and Competition Issues Arising from Patent-Derived Exclusivities in the Pharmaceutical Sector"

Our Founding Attorney, Nuri Melih İnce, delivered a presentation titled ‘Recent Decisions on Market Access and Competition Issues Arising from Patent-Derived Exclusivities in the Pharmaceutical Sector’ at the Intellectual Property Law Symposium hosted by Başkent University on 21 April 2026.
The presentation addressed a range of key issues, including:
recent judicial decisions and regulatory developments on whether activities related to marketing authorisation, pricing, and reimbursement processes fall within the scope of the Bolar exemption,
case law on the compensation of market losses where interim injunctions granted in patent disputes are subsequently lifted,
skinny labelling practices and their impact on the market entry of generic products,
the European Commission’s approach in treating the obstruction of generic entry through strategic patent filings and withdrawal practices as an abuse of a dominant position,
excessive pricing decisions of competition authorities concerning originator medicinal products in the post-COVID-19 period.
