PROTOCOL SIGNED BETWEEN THE TURKISH PERSONAL DATA PROTECTION AUTHORITY AND THE TURKISH COMPETITION A



On 26.10.2023, it was announced that the Turkish Personal Data Protection Authority (''TPDPA'') and the Turkish Competition Authority (''TCA'') signed a Cooperation and Information Sharing Protocol (''Protocol'').


In the announcements published on the TPDPA’s and the TCA’s websites, it was stated that with the development of data-driven technologies and the digital economy, significant concerns have arisen in terms of competition and rivalry in the relevant markets and the protection of personal data, and the importance of cooperation between the two authorities was emphasized.


In this context; works regarding active cooperation, such as,


  • Carrying out joint studies in emerging areas that fall within the areas of responsibility of both authorities and that may cause irreparable damage if not intervened quickly and effectively,


  • To publish reports in cooperation with both institutions in order to raise awareness among users in terms of the protection of personal data and competition, especially in digital markets, and to convey a common message to undertakings in terms of practices that relate both areas of law,


  • Organizing joint presentation and discussion programs within the scope of the TPDPA's "Wednesday Seminars" and/or the TCA's "Thursday Conferences",


  • Organizing trainings where relevant authorities share their expertise and experience in their areas of responsibility with each other,


  • Consulting on common issues in national and/or international events organized and/or attended by the relevant authorities, and supporting these events on issues that fall within the authorities' own areas


have been agreed upon with the Protocol between the TPDPA and the TCA.


With this protocol and the above-mentioned initiatives, the TPDPA and the TCA aim to protect the competitive environment and strengthen the control of consumers over their personal data.
